Human Resources Specialist (Employee & Labor Relations)

The Human Resources Specialist (Employee & Labor Relations) serves as a Subject Matter Expert on Employee and Labor Relations programs and provides advisory and technical services to managers and supervisors in the area of employee relations. The position requires expert knowledge of the Master Agreement between the Department of Veterans affairs and the American Federation of Government Employees and employee discipline matters. The overall responsibilities of the HR Specialist (Employee & Labor Relations) include, but are not limited to:
Researches and interprets complex laws, rules, regulations, case law principles and practices related to employee conduct, performance, and dispute. Formulates and present legal arguments and prepares advisory opinions and other legal and case documents. Informs employee of their rights and the avenues available to them in dealing with issues and concerns at work. Develops and propose courses of action to resolve problems based on interpretation of administrative case law, regulations and policies. Prepares ER/LR cases and serves as technical advisor to the organization. Interprets collective bargaining agreements for the bargaining unit and represent the agency in negotiations. Serves as a point of contact on major issues, requiring extensive preparation and familiarity with technical and complex issue. Represents the organization at hearings relative to all adverse actions utilizing knowledge of policies, procedures, and precedents of relevant adjudicating bodies. Conducts fact-findings to assess misconduct and to recommend appropriate actions. Communicates orally or in writing sufficient to clearly present persuasive arguments and advisory opinions and to prepare legal and case documents. Composes letters regarding the proposal and decisions of disciplinary/adverse actions, performance counseling, and performance improvement plans. Uses judgment in selecting and applying appropriate guidelines, and determining the appropriate guidelines and application. Determines new or emerging trends and precedent decisions or case law. Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-12 position you must have served 52 weeks at the GS-11. The grade may have been in any occupation, but must have been held in the Federal service. An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials. If the most recent SF-50 has an effective date within the past year, it may not clearly demonstrate you possess one-year time-in-grade, as required by the announcement. In this instance, you must provide an additional SF-50 that clearly demonstrates one-year time-in-grade. In addition to meeting the Time-In-Grade requirement, you must also qualify based on your experience as described below:

Experience:
You must have one year of specialized experience equivalent to at least the next lower grade GS-11 in the normal line of progression for the occupation in the organization. Specialized Experience required to qualify for this position is defined as:
1. Researching and interpreting legal and regulatory program guidance to include case law, United States Code, Code of Federal Regulations, and VA Handbooks and Directives. 2. Providing technical guidance, information, and assistance to management on sensitive, serious, and controversial employee relations issues. 3. Providing a wide range of advisory services to managers relative to disciplinary and adverse actions, grievances, appeals, unfair labor practices, contract violations, leave issues. 4. Conducting extensive research into employee relations cases to identify trends, patterns, or aggravating and mitigating circumstances. The regular and recurring work of the position involves sitting at a desk, conferences, meetings, etc., and occasional visits to activity work sites. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
